These Terms & Conditions of Use ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Finonest India Private Limited, together with its affiliates, subsidiaries, group companies, channel partners, agents and authorized representatives ("Finonest", "Company", "we", "our", "us"), governing your access to and use of www.finonest.com, associated websites, mobile applications, dashboards, landing pages, APIs, WhatsApp, RCS, SMS, email communication, call centre support, telecalling services and any other digital or physical medium operated by Finonest (collectively, the "Platform"). By accessing, browsing, registering on, or using the Platform, or by availing any service, product, information, referral, lead generation, financing, insurance, credit card, loan, used vehicle, dealer, or advisory service through Finonest, you acknowledge that you have read, understood and agreed to be bound by these Terms, the Privacy Policy, and all other policies, declarations and notices published by Finonest. If you do not agree with these Terms, please do not use the Platform.

3.5 Approval, sanction, pricing, interest rate, tenure, processing fee, insurance, foreclosure charges, loan-to-value ratio and disbursement are solely determined by the relevant Financial Partner.

By registering, uploading data, using the app, or submitting any information, you consent to collection and processing of your information, confirm that the information provided is accurate and lawful, authorize Finonest and its partner banks/NBFCs/insurers to contact you, and permit us to share your information with our service providers and financial partners.
If you submit information of another person (for example, a customer lead), you confirm that you have obtained that person’s valid consent.
6.1 By submitting your details or using the Platform, you expressly consent to receive calls, SMS, RCS, WhatsApp messages, emails, app notifications and other communications from Finonest, its employees, agents, telecallers, DSAs, channel partners and Financial Partners.
6.2 Such communications may relate to product offers, loan or credit card application updates, KYC reminders, marketing campaigns, payment reminders, service notifications, and promotional offers.
6.3 You expressly waive any objection under DND or NDNC regulations to the extent permitted by law for communications relating to your enquiry or application.
6.4 You may opt out of promotional communications by following the unsubscribe instructions, though service-related communications may continue.
7.1 By using Finonest, you authorize Finonest and its Financial Partners to obtain your credit report/score and related information, and access/verify/process PAN, Aadhaar, driving licence, RC, bank statements, GST details, income proof, address proof, employment details and other KYC information.
7.2 You appoint Finonest as your authorized representative solely for obtaining such information from credit bureaus and KYC agencies.
7.3 Your consent shall remain valid for six months from the date of grant unless withdrawn earlier or renewed.
7.4 Finonest may retain such information only for the period required under applicable law, regulatory requirements or business necessity.
7.5 You agree that Finonest and the relevant credit bureau shall not be liable for any delay, inaccuracy, rejection or consequence arising from bureau data or third-party KYC records.
8.1 Documents uploaded or submitted by you may be verified through banks/NBFCs, government databases, UIDAI-enabled systems where permitted, credit bureaus, KYC agencies, employers, and dealers/vehicle registration authorities.
8.2 Finonest may refuse to process an application if required documents are not submitted, documents are fake/incomplete/inconsistent, or additional verification is required.
8.3 You are solely liable for any false declaration, forged document or misrepresentation.
9.1 Finonest may provide information regarding vehicles, dealers, pricing, specifications, market values, used car listings and vehicle finance options.
9.2 Vehicle descriptions, valuation reports, estimated resale values, market pricing and dealer information are indicative only.
9.3 Finonest does not guarantee the condition/ownership/legality/quality of vehicles, pricing accuracy, or listing availability.
9.4 Buyers must independently inspect the vehicle and verify all documents and ownership details before purchase.
9.5 Sellers and dealers are solely responsible for listing accuracy, lawful ownership, transfer formalities, taxes, penalties and liabilities.
10.1 Finonest may allow telecallers, field executives, referral partners, DSAs, dealers or advisors to generate leads or promote products.
10.2 Such users must act honestly and ethically, avoid false promises or unauthorized representations, and follow applicable guidelines.
10.3 Finonest may withhold/reverse/recover incentives or payouts for fraudulent/cancelled leads or Terms breaches.
10.4 Finonest reserves the right to terminate any advisor or DSA account without notice.
11.1 The Platform may contain links, advertisements or references to third-party websites, applications or products.
11.2 Finonest does not control and is not responsible for third-party content, accuracy, security, availability or reliability.
11.3 Any transaction between you and a third party is solely between you and that third party.
11.4 Finonest shall not be liable for disputes or losses arising from interaction with third-party websites, dealers, lenders, insurers or providers.
12.1 All rights, title and interest in the Platform content, software, trademarks, logos, designs, tools and materials belong to Finonest or its licensors.
12.2 You may not copy, reproduce, republish, distribute, create derivative works, or commercially exploit Platform content without authorization.
12.3 Unauthorized use may result in civil and criminal action.
13.1 If you upload reviews, feedback, comments, photos, documents or listings, you grant Finonest a worldwide, royalty-free, perpetual and transferable licence to use and publish such content.
13.2 You warrant that you have rights to submit such content and it does not violate law or third-party rights.
13.3 Finonest may remove any content at its discretion without notice.
14.1 The Platform and all services are provided on an 'as is' and 'as available' basis.
14.2 Finonest does not warrant accuracy/completeness, uninterrupted operation, or suitability of products/services.
14.3 Reliance on Platform information is at your own risk.
14.4 Financial products involve risks and depend on policies/approval criteria of Financial Partners.
15.1 To the maximum extent permitted by law, Finonest is not liable for indirect/incidental/consequential damages, loss of profit/business/data, rejection/delay/disbursement issues, or third-party acts/omissions.
15.2 Aggregate liability of Finonest shall not exceed INR 1,000 or the amount paid by you to Finonest in the preceding three months, whichever is lower.
You agree to indemnify, defend and hold harmless Finonest and its affiliates/directors/employees/agents against claims or losses arising from breach of Terms, misuse of Platform, false information/documents, or violation of law/third-party rights.
17.1 Finonest may suspend or terminate your account/access without notice in case of Terms breach, fraud/suspicious activity, or legal/regulatory/partner requirement.
17.2 Upon termination, your right to use the Platform ceases immediately and Finonest may delete/retain your information as per law.
Finonest shall not be liable for delays/failures caused by events beyond reasonable control, including natural disasters, telecom/internet failure, cyber attacks, government restrictions, strikes, pandemics, or third-party system failures.
Your use of the Platform is also governed by the Finonest Privacy Policy, which forms an integral part of these Terms.

21.1 These Terms are governed by laws of India.
21.2 Disputes should first be attempted to be resolved amicably within 30 days.
21.3 If unresolved, dispute will be referred to a sole arbitrator appointed by Finonest under the Arbitration and Conciliation Act, 1996.
21.4 Seat and venue of arbitration shall be Jaipur, Rajasthan.
21.5 Subject to arbitration, courts at Jaipur, Rajasthan have exclusive jurisdiction.
22.1 If any provision is invalid/unenforceable, remaining provisions continue in force.
22.2 Failure to enforce any provision is not a waiver.
22.3 You may not assign rights without Finonest's written consent.
22.4 Finonest may assign rights/obligations to affiliates/successors/acquirers.
22.5 These Terms with Privacy Policy and other applicable policies form the complete agreement between you and Finonest.
